Notice of Financial Incentive/Bona Fide Loyalty Program Disclosure

This notice applies to residents of the U.S. when we offer you financial incentive programs or bona fide loyalty programs like the Fanatics ONE Loyalty Program, discounts, or special offers in exchange for your personal data. The personal data requested in connection with the offer, as well as other terms, will be provided at the time you sign up. We may share your data with Affiliates, Business Partners, and service providers to provide the program. We will provide the name of any program partners at the time you select an offer. In calculating these offers, we consider the expenses related to the offer and the value of your data. Capitalized terms not otherwise defined in this notice shall have the meaning provided in Fanatics ONE privacy policy.

In connection with the financial incentives described in this Notice of Financial Incentive, we may collect and use your personal data as described at the time of collection or as provided in the Fanatics ONE privacy policy, depending on how you interact with Fanatics Properties. For example, to offer FanCash and other benefits for Fanatics ONE Loyalty Program members, we collect and use personal information such as Personal Identifiers, Customer Records, Commercial Information, Internet Activity Data, and account credentials as described in the Fanatics ONE Privacy Policy that you provide when you sign up and engage in activities across the Fanatics Family of Companies. To provide the Fanatics ONE Loyalty Program (which may qualify as a “bona fide loyalty program” under Colorado law) offered by Fanatics Loyalty, LLC (“Fanatics Loyalty”) to eligible customers of Fanatics Loyalty and affiliated companies in accordance with the Fanatics ONE Terms & Conditions, Program Rules & Guidelines, we may disclose your personal information as described in the section of our Privacy Policy entitled “When and with whom do we share your personal data?” We may partner with certain third parties to provide benefits to Fanatics ONE Loyalty Program members.

Opting-in. Specifically, through the Properties, we may offer a “Fanatics ONE Loyalty Program,” "Bonus FanCash,” “sign up and save” offer, contest, sweepstakes, giveaway, or other reward. This means we may provide you with Fanatics ONE tier points, FanCash, a Bonus FanCash reward or one-time percentage off coupon if you agree to participate by taking specific actions on our Properties (such as signing up for a Fanatics ONE Loyalty Program account) or provide us your email address and agree to receive marketing emails, or with other offers and incentives in connection with your participation in Fanatics ONE or in any app or other Services provided by Fanatics Loyalty.

If you sign up, we may also share or sell (as defined by certain state laws) your personal data to our Business Partners as defined in our Privacy Policy. Fanatics ONE tier points may be awarded at our discretion, for example, if you participate in certain offers or promotions, we may offer from time to time. “Sign up and save” offers, once accepted will be automatically applied to your shopping cart during the same session unless you have also accepted a different site offer that provides a greater discount. If you do not use the “sign up and save” offer during that session you will receive a code via email instead. Offers may not be combined.

The Bonus FanCash or “sign up and save” offer may not be available at all times or on all Properties. The terms of the Bonus FanCash or “sign up and save” offer (including the relevant Privacy Policy and Website terms and conditions) and the amount of the one-time percentage off coupon will be presented to you at the time of the offer.

Opting-in to the Fanatics ONE Loyalty Program. You may opt-in by signing up for a Fanatics ONE account. You can opt-out at any time by closing your Fanatics ONE account.

Opting-in to Bonus FanCash and “sign up and save.” You may opt-in by agreeing to participate by taking specific actions on our Properties as specified in a Bonus FanCash offer, or providing your email address in response to the “sign up and save” offer. You can withdraw at any time by following the unsubscribe link in the email that you receive. Once you withdraw, you will no longer receive offers for Bonus FanCash, and your existing FanCash balance will not be affected.

Contests, sweepstakes, and giveaways, including those provided through our apps, may not be available at all times.  The terms applicable to such promotions and the exact financial or other reward being provided will be presented at the time of the offer.

While Fanatics does not generally assign a specific monetary value to consumers’ personal data, our good faith estimate of the value of your personal data is based on a variety of factors, including your engagement in the services and participation in the program and the expenses we incur to collect, store and keep personal information. We value our discount based on these factors and the expenses associated with offering the financial incentive and maintaining the program. 

You may withdraw from any of the programs at any time by following the instructions provided, including by closing your Fanatics ONE account. Please note that if you opt-out or request to delete your data, we may no longer be able to provide you with benefits, as Fanatics requires your personal information to manage your Fanatics ONE account. For offers involving your e-mail, you may unsubscribe via the “unsubscribe” link in any marketing email you have received. For offers involving text messaging, you may text STOP.
